Inquiry Calls For New 'Elder Law'

Michael Madigan Courier Mail - Australia - Jan 7 2008

THERE is a specific need for lawyers specialising in protecting the elderly - largely from financial abuse - a parliamentary inquiry has found.

The broad-ranging inquiry into Elderly People and the Law, which wound up late last year, also recommended the Commonwealth work with the banking and financial sector to develop national industry-wide protocols for reporting alleged financial abuse.

That could include developing a training program to help bank staff identify suspicious transactions that may point to the financial abuse, drawing on a system operating in Canada.
The committee found that the US, England and Canada had already begun specialising in "elder law".

"Elder law is an emerging new field of legal specialisation in Australia," the committee reported.
